Documents request order

The procedure for requesting documents is regulated by Rules approved by Joint Order of the Minister of Foreign Affairs of the Republic of Kazakhstan No. 08-1/1 dated 22.05.2002 and of the Minister of Justice of the Republic of Kazakhstan No. 98 dated 28.05.2002 (hereinafter – the Rules).

Citizens of the Republic of Kazakhstan, foreign citizens and stateless persons residing abroad shall, with the purpose of requesting documents from the Republic of Kazakhstan, apply to foreign establishments of the Republic of Kazakhstan. To request documents from abroad, the applicant need to apply to the relevant state body of Kazakhstan. The terms for requesting documents from the Republic of Kazakhstan are 3 months or more. For requesting documents from abroad and from the Republic of Kazakhstan, the applicant should submit the following documents:

•Application in optional form – 4 copies.

•Document request form – 4 copies (Annex No. 1).

•Copy of the document requested (if available) – 4 copies.

•Document certifying identity of the applicant – the original and a copy – 4 copies.

•Original copy of the paper confirming payment of the consular fee.

According to paragraph 4 of the Rules, originals and copies of military cards and service certificates are not subject to export, requisition or sending. Also in accordance with paragraph 16 of the Rules, the following request applications from individuals are not subject to approval:

•Duplicative certificates of civil status registration (vital records), if they are titled not in the applicant's name but in the name of other persons.

•Certificate of marriage, if the marriage is dissolved (with the issuance of corresponding reference certificate).

•Birth certificates in the name of the dead.

In accordance with paragraph 3 of the Rules, the citizens may apply for the request of the following documents:

•Documents on registration of acts of civil status (certificates of birth, death, marriage and divorce, paternity, about the change of surname, name and patronymic).

•Information of social and legal character (documents about experience, salary, pensions, education, the award of a scientific degree, conferring an academic title and further training, state and agency-level awards, facts of unjustified repression, deportation of citizens and confiscation of their property, military service, participation in labour army, etc.)

•Information about being under medical treatment, occupational diseases and accidents.

According to the Tax legislation of the Republic of Kazakhstan it is necessary to pay the consular fee, unless otherwise stipulated by international agreements ratified by the Republic of Kazakhstan. The rate of the consular fee is established by the Government of the Republic of Kazakhstan for each country individually. The consular fee is charged regardless of the results of request.

b) in case of request of documents about education, please indicate the name and address of the institution, the date of enrollment and graduation, series and number of the document requested;

c) in case of request of documents about experience, please indicate the name and address of the enterprise, institution; duration and position at work. If the applicant worked at a private individuals', then indicate last name, first name and address of the employer;

d) in case of request of documents about retirement, assigned abroad, indicate when, what and which organization granted the pension; which organization and when made the last payment of pension. Note:

It is desirable to indicate the name of the enterprise, institution and educational institution in a foreign language as well.
