on the document legalization, providing the “visa support” 
and issuance of “work-type” visa of the Republic of Kazakhstan
1. Document legalization abroad


The procedure for obtaining a permit to attract foreign labor force (hereinafter referred to as“the permit”) is regulated by the Rules of establishment of quotas to attract foreign labor force to the Republic of Kazakhstan (hereinafter referred to as «the Rules»), approved by the Decree of the Government of the Republic of Kazakhstan № 45 of January 23, 2012. 
These Rules define the list of documents to be submitted by the employer to the local authorities (Akimats) of Astana, Almaty and other regions of Kazakhstan (hereinafter referred to as “the competent authority”), required to receive the work permit. 
Some of the documents in the above mentioned list, such as diplomas, certificates of education and employment, must be legalized or notarized in accordance with the legislation of the Republic of Kazakhstan, except for the cases foreseen by the acting international treaties of the Republic of Kazakhstan. 
The documents are required to be provided with translation in Kazakh or Russian languages.
The documents are required to be certified in the Ministry of Foreign Affairs of the country of residence. Afterwards the applicant shall submit to the Consulates of the Republic of Kazakhstan abroad the following documents:
• an application in a free form;
• identification document of the applicant or constituent documents of legal entity (only for legal entities);
• the document that is a subject to consular legalization;
• a certified letter of Attorney (original) for the person, who represents the applicant’s interests (only if necessary);
• paid consular fee (original of the document).
Reciept of the documents for legalization is conducted four days a week (Monday, Tuesday, Thursday and Friday) from 10:00 till 12:00 a.m. Issuance of documents is conducted from 16:00 till 17:00 o’clock. The period of documents consideration is 3 working days.

2. Providing the “visa support” in the Department of Consular Service of the Ministry of Foreign Affairs of the Republic of Kazakhstan


To obtain the “work-type” visa of the Republic of Kazakhstan the inviting legal entity, which is registered in the territory of the Republic of Kazakhstan, must process in advance a visa support of the Department of Consular Service of the Ministry of Foreign Affairs of the Republic of Kazakhstan. Therefore, the legal entity shall provide to the Department of Consular Service the following documents:
• an invitation letter (Annex № 1);
• payment order or receipt of paid consular fees and actual costs (not required from state institutions);
• once a year - a notarized copy of the constituent documents (charter of the company, certificate of registration in the Ministry of Justice of the Republic of Kazakhstan), and an inquiry of tax clearance for the last three months;
• a letter of Attorney for the organization’s representative to submit documents to the Department of Consular Service and to receive a number of visa support;
• a copy of the permit to attract foreign labor force and the labor contract between the foreign national and the legal entity of the Republic of Kazakhstan notarized at the current year.
The foreigners, who come to Kazakhstan for work purposes and are not required to get the permit to attract foreign labor force under the international treaties or in accordance with the regulations of the Republic of Kazakhstan, shall obtain Kazakhstan visa on the basis of the written request of the legal entity, which is registered in the territory of the Republic of Kazakhstan. 
The period of documents consideration is 5 working days.

3. Obtaining the “work-type” visa


To obtain the “work-type” visa a foreign national shall submit to the Consular offices of the Republic of Kazakhstan abroad the following documents:
• an invitation letter received from the inviting organization with the number of visa support of the Department of Consular Service;
• a completed application form (Annex № 2);
• photo (3,5 X 4, 5);
• passport;
• a copy of the permit to attract foreign labor force.
The nationals of the states, where Consular offices of the Republic of Kazakhstan are not represented, can obtain visas in the Consular posts at the international airports of the Republic of Kazakhstan (Astana, Almaty, Aktau, Atyrau, Uralsk and Ust-Kamenogorsk). 
Not working members of the families, who depend upon the person, working in the territory of the Republic of Kazakhstan, shall obtain visa with a mark “without the right to work”. It is issued on the basis of the written request of the legal entity, which is registered in the Ministry of Justice of Kazakhstan, and documents confirming family relationship with the person, working in Kazakhstan, as well as copy of issued “work-type” visa. 
The work-type visa shall be issued for single-, double-, triple - and multiple-entry and exit. 
The period of documents consideration is 5 working days. 
A detailed information on legalization, providing the visa support and issuance of visas may be obtained at the official website of the Ministry of Foreign Affairs of the Republic of Kazakhstan at www.mfa.gov.kz.

Please be advised to pay attention to the following:
According to the Rules of issuance of visas of Republic of Kazakhstan, the business-category visa does not give the right to foreign citizens to be involved in labor activities in the territory of the Republic of Kazakhstan. This category of visa is issued to foreigners who travel to the Republic of Kazakhstan for negotiations, conclusion of agreements, participation in conferences, exhibitions, cultural, scientific and other events. It also has time frames for stay of a foreigner in the Republic of Kazakhstan (for example, with the multiple-entry visa the foreigner is eligible to stay in Kazakhstan no more than 120 days a year). Furthermore, the citizens of the 48 most developed states can obtain the single entry visa of this category with a simplified procedure. 
Work-category visa is issued for the whole acting period of the permit and has no time limits for stay in the country. Extension of work-category visa is produced by regional authorities of the Ministry of Interior of the Republic of Kazakhstan on the basis of a written request of the legal entity, which had initially applied for the work permit.
